Sanctioning provisions for the violation of the provisions of Regulation (EC) no. 1/2005 on the protection of animals during transport and related operations

THE PRESIDENT OF THE REPUBLIC

Having regard to articles 76 and 87 of the Constitution;

Having regard to Regulation (EC) no. 1/2005 of the Council, of 22 December 2004, on the protection of animals during transport and related operations which amends Council Directive 64/432 / EEC, of ​​26 June 1964, and Regulation (EC) no. 1255/1977;

Given the law of 25 January 2006, n. 29, and in particular article 5;

It was deemed necessary to provide implementing provisions of the aforementioned Regulation (EC) no. 1/2005 with regard in particular to the procedures for carrying out checks as well as the penalties applicable to violations of the provisions of the aforementioned Regulation and the identification of the measures necessary for them to be implemented in application of articles 25 and 26 of the Regulation same;

Given the preliminary resolution of the Council of Ministers, adopted at the meeting of 25 January 2007;

Acquired the opinion of the Permanent Conference for relations between the State, the Regions and the Autonomous Provinces of Trento and Bolzano, expressed in the session of 15 March 2007;

Having acquired the opinions of the competent Commissions of the Chamber of Deputies and of the Senate of the Republic;

Given the resolution of the Council of Ministers, adopted at the meeting of 20 July 2007;

On the proposal of the Minister for European Policies and the Minister of Justice, in agreement with the Minister of Health and Agricultural, Food and Forestry Policies;

Art. 1.
Scope and definitions

1. This decree contains the disciplinary measures for the violation of the provisions of Regulation (EC) no. 1/2005 of the Council of 22 December 2004, hereinafter referred to as: "Regulation", containing provisions on the protection of animals during transport and related operations.

2. For the purposes of this decree, the definitions referred to in Article 2 of the Regulation apply as well as the following additional definitions: "driver", the person who drives a vehicle that is transporting animals; "breeder": the person who professionally carries out animal breeding activities; "authorization", the authorization issued pursuant to articles 10 and 11 of the Regulation; "certificate of suitability", the certificate issued pursuant to Article 17, paragraph 2, of the Regulations; "type approval certificate for vehicles", the certificate referred to in Article 18 of the Regulation.

Art. 2.
Competent authority

1. The competent Authorities pursuant to article 2, letter f), of the Regulations are the Ministry of Health and the Regions and Autonomous Provinces in the areas of their respective competence.

2. In any case, all the bodies referred to in article 13 of law no. 689.

Art. 3.
Violations of the rules concerning the authorization of the transporter

1. Anyone who carries out a transport without being in possession of the prescribed authorization issued pursuant to articles 10 and 11 of the regulation, or when the same has expired, suspended or revoked, is subject to a pecuniary administrative sanction from Euro 2,000 to Euro 6,000 . The same sanction applies to anyone who carries out the transport in violation of the requirements of the authorization or the particular requirements referred to in Article 23, paragraph 3, of the Regulations, as well as to the organizer and keeper who use, for the transport of animals. , of a transporter without an authorization, or with an authorization that has expired, suspended or revoked.

2. The driver who carries out a transport without being provided with the authorization or a certified copy issued by the same competent authority to issue the authorization of the transporter, is subject to a pecuniary administrative sanction from Euro 200 to Euro 600. The transporter is jointly and severally obliged with the author of the violation for the payment of the relative sanction.

Art. 4.
Violations of the rules concerning the certificate of competence of the driver or guardian

1. Whoever, without the certificate of suitability referred to in Article 17, paragraph 2, of the Regulations or with an expired certificate of validity, suspended or revoked, carries out the activity of driver or guardian on a vehicle that transports domestic equidae or domestic animals of the bovine, ovine, caprine or swine or poultry species, is subject to a pecuniary administrative sanction from Euro 1,500 to Euro 4,500.

2. The transporter, organizer or keeper who entrusts the animals to a driver or guardian without a certificate of fitness or expired, suspended or revoked, is subject to the same sanction.

Art. 5.
Irregularity or lack of documentation

1. The transporter who, during transport, commits documentary irregularities referred to in paragraph 2 is subject to a pecuniary administrative sanction from Euro 1,000 to Euro 3,000.

2 . Documentary irregularities constitute:
to) the lack on the means of transport of a document containing the information required by article 4, paragraph 1, of the Regulation;
b) the lack on the means of transport of the Common Veterinary Entry Document (CVED) for animals from third countries for the section of the route following the control at the Border Inspection Post (P.I.F.) of entry;
c) for long journeys referred to in Article 5, paragraph 4, of the Regulation, the lack of the travel log on the means of transport or the use of a travel log that does not comply with the model provided for by the Regulations or does not specify the points of rest or transfer, according to the provisions of Annex II of the Regulations;
d) the irregular compilation of health certificates or transport documents regarding:
1. origin and ownership of animals;
2. place, date and time of departure;
3. place of destination and consignee;
4. number of animals;
5. expected duration of the trip;
is) the irregular compilation, in the journey log, of data relating to:
1. place, date and time of departure;
2. place of destination and estimated time of arrival;
3. route, checkpoints and places of rest or transfer identified;
4. expected duration of the trip;
f) compilation of the travel log by persons not entitled to do so;
g) failure to indicate the number of the veterinary certificate in the journey log;
h) the lack of possession of the veterinary certificate inside the vehicle for the entire duration of the transport.

3. Apart from the cases of concurrence in the violation, the organizer and the keeper of the animals at the place of loading are jointly and severally obliged with the transporter for the payment of the fines envisaged for the violations referred to in this article.

Art. 6.
Violations of the rules concerning the certificate of approval of the means of transport

1. The transporter, the driver or the organizer who carries out or has carried out road transport for long journeys with a vehicle not equipped with a type-approval certificate conforming to the model referred to in Article 18 of the Regulations or expired, suspended or revoked, is subject to a pecuniary administrative sanction from Euro 1,000 to Euro 3,000.

2. Apart from the cases of concurrence in the violation, the organizer and the transporter, if a person other than the transgressor, are jointly and severally obliged with the person responsible for the payment of the penalties provided for the violations referred to in paragraph 1.

3. The transporter by water, even if owner or charterer or only carrier, who carries out the transport of livestock on a nautical vessel without a certificate of approval conforming to the model referred to in Article 19 of the Regulations or with an expired certificate of validity, or suspended or revoked, is subject to a pecuniary administrative sanction from Euro 3,000 to Euro 10,000.

4. The sanctions referred to in paragraphs 1 and 3 are also applied when transport by road or by waterway is carried out using containers not equipped with a certificate of approval or with an expired, suspended or revoked certificate of validity.

5. Outside the cases of concurrence in the violation, the organizer is jointly and severally obliged with the person responsible for the payment of the financial penalties provided for for the violations referred to in paragraph 4.

Art. 7.
Violations of the provisions relating to animal welfare

1. The transporter who transports animals in violation of the eligibility requirements referred to in Annex 1 to this decree is subject to a pecuniary administrative sanction from Euro 2,000 to Euro 6,000.

2. The transporter who uses means of transport that do not comply with the requirements set out in Annex 2 to this decree is subject to a pecuniary administrative sanction from Euro 1,000 to Euro 4,000.

3. The transporter who does not comply with the transport practices referred to in Annex 3 of this decree is subject to a pecuniary administrative sanction from Euro 1,000 to Euro 3,000.

4. The transporter who in carrying out transport for long journeys of domestic equidae and domestic animals of bovine, ovine, caprine and porcine species violates one of the prescriptions set forth in Annex 4 of this decree is subject to a pecuniary administrative sanction of Euro 2,000 to 6,000 euros.

5. Unless the fact constitutes a crime, the staff who look after animals using, for the performance of their duties, violence against the animal, or the staff who cause unnecessary suffering or injury to the animal, is subject to a pecuniary administrative sanction from Euro 3,000 to Euro 15,000.

6. Unless the fact constitutes a crime, anyone who, during transport operations, uses violence against the animal or causes unnecessary suffering or injury to the animal is subject to a pecuniary administrative sanction from Euro 3,000 to Euro 15,000.

7. Apart from the cases of concurrence in the violations of the provisions referred to in Annexes 1 and 3 to this decree, the holder and the manager of the collection centers are jointly and severally obliged with the carrier for the payment of the financial penalties referred to in paragraphs 1 and 3 of this article.

8. The farmer, who in operating the transport of animals owned by him with agricultural vehicles or with his own means for a distance of less than 50 kilometers or for seasonal transhumance does not comply with the provisions of article 3 of the Regulation, is subject to to the pecuniary administrative sanction from Euro 1,000 to Euro 4,000.

Art. 8.
Various violations

1. Operators of collection centers who fail to comply with the obligations referred to in Article 9 (2), letters to), b) is c), of the Regulations are subject to an administrative sanction from Euro 400 to Euro 1,600.

2. The holder of the authorization referred to in articles 10, paragraph 1 or 11, paragraph 1, of the Regulations, who operates a transport exceeding the limits is subject to an administrative sanction from Euro 5,000 to Euro 20,000.

Art. 9.
Ancillary sanctions

1. The transporter who, with the same means of transport, commits two violations, definitively ascertained, provided for by article 7, paragraph 1, in the period of three years, is subject to the suspension of the authorization for a period of one at three months. If the period between the two violations is less than three months, the maximum duration of the suspension is applied.

2. The transporter who, with the same means of transport, commits three violations, definitively ascertained, provided for by article 7, paragraph 2 in the period of three years, is subject to suspension of the authorization for a period of fifteen days to two months. If the period between two of the three violations is less than six months, the maximum duration of the suspension is applied.

3. The transporter who, in the period of three years, commits five violations provided for by article 7, paragraphs 1 and 2, definitively ascertained, is subject to the withdrawal of the authorization.

4. In case of ascertainment of the violation referred to in article 7, paragraph 6, the suspension of the carrier's authorization is ordered for a period from fifteen days to two months. In case of reiteration, the transporter is subject to the revocation of the same.

5. The carrier against whom the revocation of the authorization has been ordered cannot obtain another authorization before twelve months.

6. The transporter who, with the same means of transport, in the period of three years, commits two violations among those provided for by article 5, paragraph 2, definitively ascertained, is subject to the suspension of the certificate of approval of the means of transport. transport for a period of one to three months. If the period between the two violations is less than three months, the maximum duration of the suspension is applied.

7. The transporter who, with the same means of transport, in the period of three years, commits three violations provided for by article 5, paragraph 2, definitively ascertained, is subject to the suspension of the certificate of approval of the means of transport for a period of fifteen days to two months. If the period between two of the three violations is less than six months, the maximum duration of the suspension is applied.

8. The transporter who, within three years, commits five violations among those provided for by article 5, paragraph 2, definitively ascertained, is subject to the revocation of the certificate of approval of the means of transport.

9. The transporter who has been subjected to the measure of the revocation of the homologation certificate of the means of transport cannot obtain another homologation certificate before twelve months.

10. When the suspension or revocation of the authorization of the transporter or of the certificate of approval of the means of transport is envisaged and the violations indicated in the preceding paragraphs are committed by transporters of another Member State, the Ministry of Health adopts, once exhausted all possible actions regarding mutual assistance and exchange of information pursuant to article 24 of the Regulation, a provision of temporary prohibition to carry out the transport of animals on the national territory, having the same duration as foreseen for the suspension of the aforementioned documents.

11. Whoever carries out a transport in violation of the provision of temporary interdiction referred to in the preceding paragraph, is subject to a pecuniary administrative sanction from Euro 2,000 to Euro 6,000. If the violation is committed with a vehicle, the accessory sanction of administrative detention for a period of sixty days is imposed. The provisions of article 214 of the legislative decree 30 April 1992, n. 285.

12. In the event of an infringement of the Regulations by a driver or guardian who holds a certificate of suitability referred to in Article 17, paragraph 2, of the Regulations, the suspension of the certificate of suitability for a period from one to three months or revocation.

13. Subjects who have ascertained a violation that provides for the application of the suspension or revocation of the haulier's authorization, of the vehicle approval certificate or of the driver's or attendant's certificate of suitability, transmit to the authority that has issued, a copy of the protest report and any other document useful for the adoption of suspension or revocation measures. If the violations are committed by a transporter from another Member State, the communication must be sent to the competent authority referred to in Article 2, paragraph 1.

Art. 10.
Emergency measures for the protection of animal welfare

1. Without prejudice to the application of the pecuniary sanctions provided for by this decree, when a violation of the provisions of the Regulations is found, the competent Authority referred to in Article 2, paragraph 1, if it is not possible to provide directly, subject responsible for animals to take the necessary actions to safeguard their well-being, identifying them among those provided for by article 23 of the Regulation. The transporter and the guardian are required to fulfill the obligations within the term indicated by the competent Authority at their own expense.

2. In the case referred to in paragraph 1, the persons who carried out the assessment shall monitor the correct observance of the prescriptions given and inform the competent Authority and the transport organizer of the measures taken. If the organizer is based in another Member State, the communications are made through the territorially competent Veterinary Office for Community Compliance (U.V.A.C.).

3. The person responsible for the violation, the carrier, the organizer and the keeper, jointly and severally, are responsible for the obligations deriving from the implementation of the measures indicated in article 23 of the Regulations.

4. Anyone who refuses to fulfill the obligations or prescriptions imposed by the competent Authority pursuant to and for the purposes referred to in paragraph 1, or, in any case, omits or delays their fulfillment in whole or in part, is subject to a pecuniary administrative sanction from Euro 2,000 to Euro 6,000. In case of direct execution by the administrative authority of the said obligations and prescriptions, the relative expenses are charged entirely to whoever is obliged to fulfill them.

Art. 11.
Request for information or exhibit documents

1. The control authorities have the right to ask the travel organizers, transporters, transport managers referred to in Article 5, paragraph 2, of the Regulations or the keepers of the animals transported, as well as the drivers and guardians, information relating to the trip or the exhibition of documents, certificates, relating to the animals and people employed on the trip itself.

2. The invitation to provide information or to exhibit documents can be formulated at the time of the check or notified at a later time. It contains the term within which the information must be provided and the documents exhibited, not less than ten nor more than thirty working days starting from the moment in which the recipient of the invitation has had legal knowledge.

3. Without prejudice to the provisions of article 5, whoever, without justified reason, does not comply with the invitation referred to in paragraph 1 within the established term is subject to a pecuniary administrative sanction from Euro 400 to Euro 1,200.

4. The transporter who fails to designate the natural person responsible for the transport, if not performed directly, is subject to an administrative sanction from Euro 200 to Euro 800.

5. The transporter who does not communicate within fifteen days to the competent Authority, even if not national, identified on the basis of the destination of the transport, of the changes made in relation to the requirements necessary for the purpose of issuing the authorizations referred to in Articles 10, paragraph 1, and 11, paragraph 1, of the Regulations is subject to a pecuniary administrative sanction from Euro 200 to Euro 800.

Art. 12.
Procedure for applying sanctions

1. For the purposes of ascertaining and imposing the sanctions provided for in this decree, the provisions of law no. 689, as compatible.

2. The subjects who ascertain violations of the provisions of this decree draw up an assessment report in accordance with Annex 5.

3. The Regions and the Autonomous Provinces are the competent Authority for the imposition of sanctions. When the violation refers to intra-community transport or to third countries, the authority responsible for imposing sanctions is the U.V.A.C. competent for the territory.

4. Except for the provisions of article 9, paragraphs 10 and 11, when a violation is committed using a vehicle registered abroad, the provisions of article 207 of legislative decree no. 285.

5. The vehicle subjected to administrative detention pursuant to article 207 of legislative decree no. 285 or article 9, paragraph 11, of this decree is entrusted in custody, at the expense of the person responsible for the violation, to one of the subjects indicated in article 214-BIS of the aforementioned legislative decree no. 285 of 1992. The animals are hospitalized, at the expense of the person responsible for the violation, in a place that guarantees the protection of their well-being in compliance with the regulations in force on the matter.

6. The entity of the sanctions provided for by this decree is updated every two years to an extent equal to the entire variation, ascertained by ISTAT, of the consumer price index for blue-collar and white-collar families (national average). in the previous two years. For this purpose, by 1 December of each two-year period, the Minister of Health, in agreement with the Minister of Economy, Finance and Justice, establishes, following the above criteria, the new limits of administrative pecuniary sanctions, which they apply from January 1st of the following year. These limits may exceed the maximum limits indicated in the law of 24 November 1981, n. 689. The measure of administrative pecuniary sanctions, updated according to the aforementioned provisions, is rounded up to the unit of euro, upwards if the decimal fraction is equal to or greater than 50 euro cents, or downwards if it is below that limit.

Art. 13.
Proceeds from administrative pecuniary sanctions

1. The proceeds of the administrative pecuniary sanctions for the violations provided for by this decree are devolved to the State, when ascertained by the U.V.A.C. and to the Regions and Autonomous Provinces in the remaining cases.

Art. 14.
Transitional provisions and repeals

1. Without prejudice to the competences of the Regions and Autonomous Provinces, in the phase of first application of the provisions of this decree, the certificate of approval referred to in Article 18 of the Regulation and the authorization of the carrier referred to in Article 6, paragraph 1, of the Regulations are issued by the veterinary services of the AUSL respectively competent by reason of the operational headquarters or the registered office of the transporter.

2. The provisions referred to in Article 4 come into force on January 6, 2008.

3. By 5 January 2008, the driver or guardian of the animals must acquire, following a specific training course, the certificate of suitability for transporting the animals, which has a ten-year duration. Up to that date, any reference to this certificate contained in this decree must be understood as referring to the certification referred to in article 5, paragraph 2, of legislative decree no. 532.

4. The training courses referred to in the previous paragraph can be carried out by Bodies, Institutes, Trade Associations and professional Associations independently or in collaboration with each other at the expense of the interested parties.

5. Legislative decree no. 532.

6. Within ninety days from the entry into force of this decree, the Minister of Health, in agreement with the Minister of Economy and Finance, the Minister of the Interior and the Minister of Agricultural, Food and Forestry Policies, issues a decree of coordination of the activities of control and application of the Regulations.

Art. 15.
Financial provisions

1. This decree must not result in new or greater charges, nor lower revenues for the public finance.

2. The public subjects concerned carry out the activities envisaged by this decree with the human, financial and instrumental resources available under current legislation.

ATTACHMENT 1
(provided for by art.7, paragraph 1)
SUITABILITY FOR THE TRANSPORT OF ANIMALS

1. No animal may be transported that is not suitable for the intended journey, nor may the transport conditions be such as to expose the animal to unnecessary injury or suffering.

2. Animals presenting lesions or physiological problems or pathologies should also not be considered suitable for transport if:
to) they are unable to move independently without suffering or to walk unaided;
b) have a severe open wound or prolapse;
c) they are pregnant females who have exceeded 90% of the expected gestation period or females who have given birth during the previous week;
d) they are newborn mammals whose navel is not completely healed yet;
is) they are pigs of less than three weeks, sheep of less than one week and calves of less than 10 days, unless they are transported for distances of less than 100 km.

3. However, sick or injured animals may be considered fit for transport if:
to) have minor injuries or illnesses and their transport would not cause additional suffering; in cases of doubt, a veterinary opinion is sought;
b) are transported for the purposes of Council Directive 86/609 / EEC (1) if the disease or injury is part of the research program;
c) are transported under veterinary supervision for or following veterinary treatment or diagnosis. However, such transport is allowed only if it does not cause the animal unnecessary suffering or mistreatment and are animals that have undergone veterinary procedures in relation to zootechnical practices, such as decoration or castration, provided that the wounds are completely healed. .

4. When animals become ill or injured during transport, they are separated from others and receive adequate care as soon as possible. They receive appropriate veterinary treatment and, where appropriate, are subjected to emergency slaughter or killing in a way that does not cause them unnecessary suffering.

5. The administration of sedatives to animals intended for transport is not permitted, unless this is strictly necessary to ensure the welfare of the animals and only under veterinary supervision.

6. Lactating females of the bovine, ovine and caprine species, if not accompanied by their offspring, are milked at intervals not exceeding 12 hours.

7. The provisions referred to in point 2, letters c) is d) they do not apply to registered mares if the trip is aimed at improving the health and welfare conditions for the birth nor to newborn foals with registered mothers if in both cases the animals are always accompanied by a guardian assigned to them during the travel.

ANNEX 2
(provided for by art.7, paragraph 2)
MEANS OF TRANSPORT

1. Provisions for all means of transport.
1.1 Means of transport, containers and their equipment are designed, constructed, maintained and used in such a way as to:

to) avoid injuries and suffering and ensure the safety of animals;
b) protect animals from bad weather, extreme temperatures and adverse climatic variations;
c) be cleaned and disinfected;
d) prevent animals from escaping or falling out and being able to withstand the stresses caused by movements;
is) ensure that the appropriate quantity and quality of air can be maintained according to the species transported;
f) guarantee access to animals so as to allow inspection and care;
g) have a non-slip flooring surface;
h) have a floor surface that minimizes the leakage of urine or faeces;
the) provide sufficient lighting for inspection and care of animals during transport.

1.2 Sufficient space must be provided in the animal compartment and at each of its levels to ensure that there is adequate ventilation over the animals when they are in a natural upright position, without impeding their natural movement for any reason.

1.3 For wild animals and for species other than domestic equidae or domestic animals of the bovine, ovine and porcine species, where appropriate, the animals are accompanied by the following documents:
to) a note indicating that the animals are wild, fearful or dangerous;
b) written instructions regarding the administration of food and water and any special care required.

1.4 The bulkheads must be strong enough to withstand the weight of the animals. The equipment must be designed to be able to operate quickly and easily.

1.5 Piglets of less than 10 kg, lambs of less than 20 kg, calves of less than six months and foals of less than four months of age must have adequate bedding or equivalent adequate material to ensure their welfare in operation the species, the number of animals transported, the duration of the journey and the weather conditions. The material must allow adequate absorption of manure.

1.6 Without prejudice to Community or national regulations on the safety of crews and passengers, if transport on a ship, aircraft or railway wagon is intended to last more than three hours, a means of abatement suitable for transported species must be available to the keeper or a person on board who has the necessary skills to kill an animal in a humane and effective way.

2. Additional provisions for road or rail transport.
2.1 Vehicles in which animals are transported are clearly and visibly marked to indicate the presence of live animals.

2.2 Vehicles carry suitable equipment for loading and unloading.

2.3 When composing railway trains and during all other movements of the wagons, all precautions must be taken to avoid shaking the wagons containing animals.

3. Additional provisions for transport on ferries.
3.1 Before loading onto a ferry, the captain checks that, when the vehicles are loaded:
to) on internal decks, the ship is equipped with an appropriate forced ventilation system and an alarm system and an adequate secondary source of energy in case of failure;
b) on open decks, there is adequate protection from sea water.

3.2 I veicoli stradali e i vagoni ferroviari devono essere dotati di un numero sufficiente di punti di fissaggio adeguatamente progettati, posizionati e mantenuti per consentire che siano saldamenti fissati alla nave. I veicoli stradali e i vagoni ferroviari sono assicurati alla nave prima dell'inizio del viaggio, per evitare che siano spostati dai movimenti della nave.

4. Disposizioni addizionali per il trasporto per via aerea. 4.1 Gli animali devono essere trasportati in contenitori, recinti o stalli appropriati alle specie, conformi ai regolamenti dell'Associazione internazionale dei trasporti aerei (IATA) per il trasporto di animali vivi.

4.2 Gli animali possono essere trasportati soltanto in condizioni in cui e' possibile mantenere la qualita' dell'aria, la temperatura e la pressione entro limiti appropriati per l'intero viaggio, tenendo conto delle specie trasportate.

5. Disposizioni addizionali per il trasporto in contenitori.
5.1 I contenitori in cui sono trasportati animali devono essere contrassegnati in modo chiaro e visibile per indicare la presenza di animali vivi e qual e' la parte alta del contenitore.

5.2 Durante il trasporto e nella movimentazione i contenitori devono essere sempre tenuti con la parte alta in alto e si devono ridurre al minimo gli scossoni o i sobbalzi forti. I contenitori sono fissati in modo da evitare che si spostino durante la marcia del mezzo di trasporto.

5.3 I contenitori superiori ai 50 kg devono essere dotati di un numero sufficiente di punti di fissaggio adeguatamente progettati, posizionati e mantenuti per consentire che siano saldamente fissati al mezzo di trasporto su cui sono caricati. I contenitori sono assicurati al mezzo di trasporto prima dell'inizio del viaggio per evitare che siano spostati dai movimenti del mezzo di trasporto;
f) sono cani e gatti di meno di otto settimane di eta', tranne quando sono accompagnati dalla madre;
g) sono cervidi nel periodo di rinnovo delle corna.

PRATICHE DI TRASPORTO

1. Nel carico, scarico e accudimento degli animali si deve prestare debita attenzione all'esigenza di certe categorie di animali, come gli animali selvatici, di acclimatarsi al mezzo di trasporto prima dell'inizio del viaggio previsto.

1.1 Quando le operazioni di carico o scarico durano piu' di quattro ore, eccetto per il pollame:
a) devono essere disponibili strutture appropriate per tenere, nutrire e abbeverare gli animali al di fuori del mezzo di trasporto senza che essi siano legati;
b) le operazioni devono essere sorvegliate da un veterinario riconosciuto e si devono prendere precauzioni particolari per assicurare che il benessere degli animali sia mantenuto adeguatamente durante tali operazioni.

Strutture e procedure.

1.2 Le strutture per il carico e lo scarico, compreso l'impiantito, devono essere progettate, costruite, mantenute e usate in modo da:
a) prevenire lesioni e sofferenze e ridurre al minimo l'agitazione e il disagio durante gli spostamenti degli animali e assicurarne l'incolumita'. In particolare, le superfici non devono essere scivolose e devono esservi protezioni laterali in modo da impedire la fuga degli animali;
b) essere pulite e disinfettate.

1.3
a) Le rampe non devono avere pendenza superiore a un angolo di 20 gradi, vale a dire il 36,4% rispetto all'orizzontale, per i suini, i vitelli e i cavalli e ad un angolo di 26° 34', vale a dire il 50% rispetto all'orizzontale, per gli ovini e i bovini diversi dai vitelli. Quando l'inclinazione e' superiore a 10 gradi, vale a dire il 17,6% rispetto all'orizzontale, le rampe devono essere munite di un sistema, ad esempio delle assi trasversali per le zampe, che permetta agli animali di salire o scendere senza rischi o difficolta';
b) le piattaforme di sollevamento e i piani superiori devono essere muniti di barriere di protezione che impediscono la caduta o la fuga degli animali durante le operazioni di carico e scarico.

1.4 Le merci trasportate nello stesso mezzo di trasporto degli animali devono essere posizionate in modo da non causare lesioni, sofferenze o disagi agli animali.

1.5 Durante le operazioni di carico e scarico deve essere assicurata un'illuminazione appropriata.
1.6 Allorche' su un mezzo di trasporto sono caricati su piu' livelli contenitori con animali, si devono prendere le precauzioni necessarie:
a) per evitare che l'urina e le feci cadano sugli animali posti al livello inferiore o, nel caso del pollame, dei conigli e degli animali da pelliccia, per limitare tale situazione;
b) per assicurare la stabilita' dei contenitori;
c) per assicurare che la ventilazione non sia impedita.

Trattamento degli animali.

1.7 E' proibito:
a) percuotere o dare calci agli animali;
b) comprimerne parti sensibili del corpo in modo tale da causare loro dolore o sofferenze inutili;
c) sospendere gli animali con mezzi meccanici;
d) sollevare o trascinare gli animali per il capo, le orecchie, le corna, le zampe, la coda o il vello o trattarli in modo tale da causare loro dolore o sofferenze inutili;
e) usare pungoli o altri strumenti con estremita' aguzze;
f) ostruire volutamente il passaggio di un animale spinto o condotto per qualsiasi luogo in cui gli animali debbano essere trattati.

1.8 Deve essere evitato, nella misura del possibile, l'uso di strumenti che trasmettono scariche elettriche. In ogni caso tali strumenti sono usati solo su bovini o suini adulti che rifiutano di spostarsi, e soltanto se hanno davanti a se' spazio per muoversi. Le scariche non devono durare piu' di un secondo, devono essere trasmesse ad intervalli adeguati e applicate soltanto ai muscoli dei quarti posteriori. Le scariche non devono essere applicate ripetutamente se l'animale non reagisce.

1.9 Quando necessario i mercati o i centri di raccolta devono fornire dispositivi appropriati per legare gli animali. Gli animali non abituati ad essere legati devono restare slegati. Gli animali debbono avere accesso all'acqua.

1.10 Gli animali non devono essere legati per le corna, i palchi, gli anelli nasali ne' per le zampe legate assieme. Ai vitelli non deve essere messa museruola. Gli equidi domestici di oltre otto mesi devono recare cavezze durante il trasporto, fatta eccezione per i cavalli non domati. Se gli animali devono essere legati, le corde, le pastoie o gli altri mezzi usati devono essere:
a) sufficientemente forti per non spezzarsi durante condizioni di trasporto normali;
b) tali da consentire agli animali, se necessario, di coricarsi e di mangiare e bere;
c) concepiti in modo tale da eliminare il pericolo di strangolamento o di lesione ma anche da permettere di liberare rapidamente gli animali.

Separazione.

1.11 Gli animali sono accuditi e trasportati separatamente nei seguenti casi:
a)animali di specie diverse;
b)animali di taglia o eta' significativamente diverse;
c) verri o stalloni adulti da riproduzione;
d) maschi sessualmente maturi e femmine;
e) animali con corna e animali senza corna;
f)animali reciprocamente ostili;
g) animali legati e animali slegati.

1.12 Le lettere a), b), c) ed e) del punto 1.11 non si applicano qualora gli animali siano stati allevati in gruppi compatibili, siano abituati gli uni agli altri, qualora la separazione causi loro disagio o qualora le femmine siano accompagnate da prole non ancora autosufficiente.

2. Durante il trasporto.
2.1 Gli spazi messi a disposizione devono corrispondere almeno alle cifre riportate, per quanto concerne gli animali e i rispettivi mezzi di trasporto, nell'Allegato 1 capo VII del regolamento.

2.2 Se il veicolo e' caricato su una nave traghetto ro-ro, gli equidi domestici fatta eccezione per le femmine che viaggiano con i loro puledri sono trasportati in stalli individuali. E' possibile derogare alla presente disposizione in forza di disposizioni nazionali che gli Stati membri sono tenuti a notificare al comitato permanente per la catena alimentare e la salute degli animali.

2.3 Gli equidi non devono essere trasportati in veicoli ripartiti su piu' livelli, a meno che gli animali non siano caricati al livello inferiore senza che vi siano altri animali ai livelli superiori. L'altezza interna minima del compartimento deve essere piu' alta di almeno 75 cm dell'altezza al garrese dell'animale piu' alto.

2.4 Gli equidi non domati non devono essere trasportati in gruppi di piu' di quattro animali.

2.5 I punti da 1.10 a 1.13 si applicano per analogia ai mezzi di trasporto.

2.6 Si deve assicurare una ventilazione sufficiente a soddisfare pienamente i bisogni degli animali tenendo conto, in particolare, del numero e tipo degli animali da trasportare e delle condizioni meteorologiche previste per il viaggio. I contenitori devono essere sistemati in modo tale da non impedirne la ventilazione.

2.7 Durante il trasporto gli animali devono essere abbeverati, nutriti e avere l'opportunita' di riposare conformemente alle esigenze della loro specie e eta', a intervalli appropriati e, in particolare, secondo quanto enunciato nell'Allegato 1 capo V del regolamento. Ove non altrimenti precisato, i mammiferi e gli uccelli sono nutriti almeno ogni 24 ore e abbeverati almeno ogni 12 ore. L'acqua e gli alimenti devono essere di buona qualita' ed essere presentati agli animali in modo da ridurre al minimo le possibilita' di contaminazione. Occorre prestare debita attenzione alla necessita' degli animali di abituarsi alle modalita' di nutrizione e abbeveramento.

LUNGHI VIAGGI

Tetto.

1.1 Il mezzo di trasporto e' attrezzato con un tetto di colore chiaro ed e' adeguatamente isolato.
Pavimento e lettiera.

1.2 Gli animali sono forniti di una lettiera appropriata o di materiale equivalente che ne garantisca il benessere in funzione della specie, del numero di animali trasportati, della durata del viaggio e delle condizioni atmosferiche. Il materiale deve consentire un assorbimento adeguato delle deiezioni.
Alimentazione.

1.3 I mezzi di trasporto devono recare una quantita' sufficiente di alimenti appropriati per le necessita' alimentari degli animali in questione durante il viaggio. Gli alimenti devono essere protetti dalle condizioni atmosferiche e da contaminanti come polvere, carburante, gas di scarico e urina e escrementi di animali.

1.4 Allorche' per nutrire gli animali sia necessaria un'attrezzatura specifica di somministrazione degli alimenti, tale attrezzatura deve essere presente sul mezzo di trasporto.

1.5 Quando si usa un'attrezzatura di somministrazione degli alimenti come previsto al punto 1.4, questa deve essere progettata in modo tale da poter essere, ove necessario, fissata al mezzo di trasporto per evitarne il capovolgimento. Quando il mezzo di trasporto e' in movimento e l'attrezzatura non e' usata, questa e' sistemata separatamente dagli animali. Divisori.

1.6 Gli equidi sono trasportati in stalli individuali, fatta eccezione per le femmine che viaggiano con i loro puledri.

1.7 Il mezzo di trasporto deve essere dotato di divisori in modo da poter creare compartimenti separati, assicurando nel contempo a tutti gli animali un accesso libero all'acqua.

1.8 I divisori devono essere progettati in modo tale da poter essere sistemati in diverse posizioni per far si' che la dimensione del compartimento possa essere adattata ai requisiti specifici, al tipo, alla taglia e al numero degli animali. Criteri minimi per talune specie.

1.9 Salvo se accompagnati dalla madre, i lunghi viaggi sono consentiti per gli equidi domestici e gli animali domestici delle specie bovina e suina soltanto se:
gli equidi domestici hanno piu' di quattro mesi di eta', ad eccezione degli equidi registrati;
i vitelli hanno piu' di quattordici giorni dieta;
i suini pesano piu' di 10 Kg.
I cavalli non domati non sono trasportati per lunghi viaggi.

2. Riserva d'acqua per il trasporto in contenitori su strada, su rotaia o via mare.
2.1 Il mezzo di trasporto e i contenitori via mare devono essere dotati di una riserva d'acqua che renda possibile al guardiano la fornitura immediata di acqua ogni qualvolta sia necessario durante il viaggio in modo che ogni animale possa abbeverarsi.

2.2 I sistemi di abbeveramento devono essere in buone condizioni di funzionamento e adeguatamente progettati e posizionati per le categorie di animali da abbeverare a bordo del veicolo.

2.3 La capacita' totale dei serbatoi d'acqua deve essere almeno pari all'1,5% del peso del carico utile massimo del mezzo di trasporto. I serbatoi d'acqua devono essere progettati in modo da poter essere svuotati e puliti dopo ciascun viaggio e devono essere dotati di un sistema che permetta di controllare il livello dell'acqua. Essi devono essere collegati ad abbeveratoi siti nei compartimenti e mantenuti in buone condizioni di funzionamento.

2.4 E' possibile derogare al punto 2.3 per i contenitori via mare utilizzati esclusivamente sulle navi in grado di erogare acqua dai propri serbatoi di acqua.

3. Sistemi di ventilazione per i mezzi di trasporto su strada e controllo della temperatura.
3.1 I sistemi di ventilazione sui mezzi di trasporto su strada devono essere progettati, costruiti e mantenuti in modo tale che, in qualsiasi momento del viaggio, indipendentemente dal fatto che il mezzo di trasporto sia in sosta o in marcia, essi possano mantenere una forcella di temperatura compresa tra i 5 gradi centigradi ed i 30 gradi centigradi all'interno del mezzo di trasporto, per tutti gli animali, con tolleranza di +/- 5 gradi centigradi in funzione della temperatura esterna.

3.2 Il sistema di ventilazione deve essere in grado di assicurare una distribuzione regolare dell'aria, con un flusso minimo d'aria per una capacita' nominale di 60 m3/h/KN di carico utile. Esso deve essere in grado di funzionare, indipendentemente dal motore del veicolo, per almeno quattro ore.

3.3 I mezzi di trasporto devono essere dotati di un sistema di controllo della temperatura come anche di un sistema per registrare tali dati. Sensori devono essere installati nelle parti del veicolo che, per le loro caratteristiche, rischiano di essere esposte alle condizioni climatiche peggiori. Le registrazioni della temperatura cosi' ottenute devono essere datate e, a richiesta, messe a disposizione dell'autorita' competente.

3.4 I mezzi di trasporto su strada devono essere dotati di un sistema di allarme per allertare il conducente quando la temperatura nei compartimenti in cui si trovano gli animali raggiunge il limite massimo o quello minimo.
